King Killer Audio — Terms of Service

These Terms govern your use of the King Killer Audio website and your purchases from it. By using this site or buying a product, you agree to them. If you don't agree, don't use the site.
1. Who we are
King Killer Audio ("KKA," "we," "us") is a Michigan limited liability company, King Killer Audio LLC, that sells custom guitar tracking services and guitar loop and sample packs directly to customers through this website. Contact: info@kingkilleraudio.com.
2. What we sell
We sell two kinds of products, delivered two ways:
• Custom tracking services — made-to-order guitar recording, produced for your specific project at a fixed price and delivered to you by email. Current services are Custom Tracking (Section, $150), Custom Tracking (Full Song, $250), and the Custom Guitar Hooks & Loops 10-Pack ($150).
• Loop and sample packs — pre-made downloadable digital audio files, delivered instantly by download.
Nothing physical ships. Custom services are delivered by email; packs are delivered by instant download.
3. Pricing and payment
Prices are listed on each product page in USD and may change without notice. Payments are processed through our website platform, Wix, and its connected payment providers. We don't store your full payment card details. You're responsible for any taxes that apply to your purchase unless we're required to collect them.
4. Delivery
• Custom services are made to order and delivered by email on the timeline stated on the product page or agreed in writing. After purchase, you may need to provide project details (key, feel, reference track, or similar) before work begins.
• Digital packs are delivered electronically once payment clears — typically via an instant download link or email.
For both, it's your responsibility to provide a working email address and to download your files.
5. Refunds
Refunds are governed by our Refund Policy. In short: custom services can be canceled for a full refund before work begins and are non-refundable once work has started, subject to each service's revision policy; digital packs are final once downloaded. Support for corrupt, defective, or mis-described files is available as described in that policy.
6. Product usage and licensing
Your right to use the audio you purchase — whether a custom recording or a pack — is governed by our License Agreement. These Terms of Service do not grant any usage rights; the License Agreement does. If the two ever conflict on a usage question, the License Agreement controls.
7. Acceptable use of the site
Don't use this site to break the law, infringe others' rights, or interfere with how the site works. Specifically, don't:
• Copy, scrape, resell, or redistribute site content except as your License Agreement allows.
• Attempt to access accounts, data, or systems that aren't yours.
• Upload anything harmful or disrupt the site's operation.
We may suspend or refuse service to anyone who violates these Terms.
8. Intellectual property & AI use
All site content — text, images, audio previews, logos, and the King Killer Audio name — belongs to KKA or its licensors and is protected by law. Buying a product gives you the usage rights in the License Agreement and nothing more.
No AI training or data mining. All content on this site — including audio (demos, previews, product clips, and any playable or downloadable audio), images, text, and code — is owned by King Killer Audio LLC and protected. No one may use, copy, scrape, or ingest any site content to train, fine-tune, develop, or evaluate any AI or machine learning model, system, or dataset, or for any text-and-data-mining purpose. This applies to everyone who accesses the site — people and automated agents, crawlers, and bots alike.
Accessing the site does not grant any such right. King Killer Audio LLC expressly reserves all rights against AI and text-and-data-mining use of its content. This reservation binds every visitor to the site, not only purchasers, and is in addition to the Sample Pack License Agreement, which separately governs the use of purchased samples.
9. Disclaimer and limitation of liability
Our products and services are provided "as is." To the fullest extent allowed by law, KKA isn't liable for any indirect, incidental, or consequential damages arising from your use of the site, products, or services. Our total liability for any claim is limited to the amount you paid for the order the claim relates to.
10. Governing law
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Kalamazoo County, Michigan.
11. Changes to these Terms
We may update these Terms. The "last updated" date shows the current version. Continuing to use the site after a change means you accept it.
